Basic Principles of Regulation

The Ministry of Digital Transformation of Ukraine has published the basic principles for regulating the artificial intelligence (AI) sector in the country, which are set out in a document called “White Paper”. As previously announced, the EU AI Act regulation became the basis for the department’s approach.

According to the roadmap, the preparatory stage for the implementation of new rules will take from two to three years. During this period, recommendations will be published and a regulatory sandbox will be created to test the new norms.

Goals and Interests

The official release of the Ministry of Digital Development notes that the developed approach takes into account the interests of all key stakeholders - citizens, business and the state. The main goal is to protect the rights of Ukrainians without impeding the development of innovation. Thanks to the chosen approach, Ukrainian companies will be able to become more competitive and enter international markets. For the state, this is an opportunity to integrate into the EU by synchronizing its legislation in the field of AI with European legislation.

Regulation Principle

The industry will be regulated on a bottom-up basis. This approach involves preparing market participants for new realities before implementing the rules themselves. The regulatory framework will be based on the AI ​​Act regulations, which was emphasized by Alexander Bornyakov, Deputy Minister of Digital Transformation for the Development of the IT Sphere.

At the initial stage, the business will receive various tools to prepare for future realities. Among them:
- Industry recommendations
- “Codes of Conduct”
- Legal assistance platform
- Regulatory sandbox for testing new regulations

“We will provide businesses with all the necessary tools so that they can prepare for the new realities. These are industry recommendations, “codes of conduct,” a legal assistance platform and a regulatory “sandbox” for testing new norms,” Bornyakov noted.

Background and Context

Let us recall that the Ministry of Digital Development presented a roadmap for regulating the AI ​​sector in October 2023. According to this document, the preparatory phase will take two to three years, which will allow time to create recommendations and test new rules in a controlled environment.
