Ex Populus Sues Elon Musk Over Similarity of Xai and xAI Brands

In 2023, Ex Populus studio introduced the Xai gaming platform, designed for video game developers and using artificial intelligence solutions. According to the lawsuit filed in the federal court for the Northern District of California, the platform has faced a problem in recent months: it is often confused with Elon Musk's company xAI, which also works in the field of AI.

According to the plaintiff, the rights to the Xai brand were officially registered back in June 2023. Despite this, Musk continued to use an almost identical name for his company. Ex Populus was further displeased by the fact that the Grok neural network, developed by xAI, mistakenly linked the official Ex Populus account on the X social network with Musk's projects.

The situation had a negative impact on the position of the platform's own token, XAI. Its rate plummeted by 92%, reaching $0.048, and its capitalization decreased to $83.5 million. The management of Ex Populus emphasized that their brand has long established itself in the video game industry, and due to confusion with Musk's company, users began to be misled. The team's statement notes that the company intends to continue legally protecting its name, since the trust of the gaming community is of key importance to them.

It is noteworthy that during the same period, the Grok neural network presented a forecast according to which Bitcoin could strengthen its position as the most attractive asset for investment in the next ten years. Among the factors named are the limited emission of the coin, growing interest from large corporations, and increasing inflation.

The case of Ex Populus shows how serious the consequences of even a partial overlap of brands can be in the context of the rapid development of the artificial intelligence field. For companies working at the intersection of technology and cryptocurrencies, such situations become not only a reputational challenge, but also a financial one. In the near future, the court will have to determine whether Musk violated the rights of competitors and what measures will be taken to protect the interests of Ex Populus.
